Open Burning Regulations In Miami Township

The following regulations are from Miami Township's adopted fire prevention code. Failure to comply with these regulations WILL RESULT in CITATIONS and or FINES to the person(s) causing the open burn in Miami Township. The minimum fine is $1000.00 for the first offense.

The Fire Chief or the Fire Marshall (Code Official) reserves the right to modify these restrictions. Open Burn Checklists are included in this document to assist the resident in assuring compliance with the Miami Township Fire/RAPCA Codes.

Open Burning In Montgomery County

Open burning in Montgomery County is controlled by the Regional Air Pollution Control Agency. This agency controls the issuing of permits for open burning in Miami Township.

An "Open Burn" is defined as a fire to remove yard waste i.e.: Large cleanup of twigs, limbs, debris.

Open burning on Ozone Action Days is prohibited. To find out which days are designated Ozone Action Days, call the Air Line at (937) 913-2000 during the ozone season (April - October). There are no Ozone Action Days in the colder months of the year.

Open Burn Fires Checklist: Permit Required From RAPCA/Miami Township Fire Department

- Pile may be no larger than 5'X5'X5' in size.
- Burning Hours are between 10 am to 4 pm
- Maintain all fires in a nuisance free fashion.
- Notify Miami Township Fire Department Communication Center at (937) 433-4400 prior to burning and at end of burning.
- Only Clean, Dry Wood may be burned
- Remove all asphalt shingles, trash, tires, furniture, mattresses, and all other smoke producing materials.
- Obtain PERMIT from RAPCA Regional Air Pollution Control (937) 225-4435 prior to burning and permit must be on site during burning
- Obtain PERMIT from Miami Township Fire Department (937) 433-4242 prior to burning and permit must be on site durning burning. This permit will only be issued upon permit from RAPCA.
- Extinguishing Agent must be at site. ABC Fire extinguisher with a minimum 4A rating, Dirt, Sand, Water Barrel or Garden Hose at all times.
- Burn only when wind speed is less than 12 mph.
- Ozone Action Day Verification Call (937) 913-2000 Option #2, Option #1 Open burning on Ozone Action Days is prohibited.
- Burn site must be 1000' from neighboring residences.

Recreational Fire Regulations In Miami Township Checklist

- May be no larger than 3X2 in size
- Utilized to cook food for consumption
- 25' from any structure, or combustible material
- 15' from any structure, or combustible material in an Approved Container (An approved container is any device manufactured for recreational fires that contains the sparks produced by recreational fires; these devices must be approved in writing by Miami Township Fire Department. Contact the fire department for approval at (937) 433-4242 X269)
- Extinguishing Agent must be at site. ABC Fire extinguisher with a minimum 4A rating, Dirt, Sand, Water Barrel or Garden Hose at all times.
- Ozone Action Day Verification Call (937) 913-2000 Option #2, Option #1 Open burning on Ozone Action Days is prohibited.
- Dispatch Notification Call (937) 433-4401 prior to lighting Fire and at completion of fire.

Miami Township wishes all of its residents to have recreation and fun while in the township; these restrictions are to provide safety for all residents.
